Special Conditions of Purchase
These Special Conditions of the Purchase Contract apply to online sales made through titilante.com www.titilante.com, owned by Titilante Ediciones S.L., with registered office for this purpose at Paseo de los Melancólicos 35, 3º Izda., 28005 Madrid, C.I.F. number: B87992103 and e-mail hola@titilante.com.
The use by the client of the services proposed on titilante.com presupposes, in any case, the acceptance of these Special Conditions of the Online Purchase Agreement, in the version published by titilante.com, at the moment of the purchase order. Therefore, it is convenient that the customer reads these Special Conditions before proceeding to make a purchase, as well as the general terms and conditions of use of the site.
Please also read our Privacy Policy before placing your order. By using titilante.com or placing an order through it, you agree to be bound by these Terms and our Privacy Policy.
1. Purpose of the contract
Las presentes condiciones particulares de compra online se aplican a la compra de cualquier producto presente en el titilante.com.
The prices of each are indicated on the website on the date of the order. The prices are detailed on each item including taxes and fees. The amount of the shipping costs and any other service is also specified and will be indicated to the customer in a detailed way at the time of placing the order.
The purchase service through titilante.com regulated in these Particular Conditions only allows the purchase of products and services to customers over 18 years old.
TITILANTE reserves the right to cancel a customer’s access account if fraudulent, speculative or dishonest acts are detected in the use of this service.
TITILANTE will modify and update, if it considers it appropriate, articles and prices according to the commercial criteria of the company, although the changes will not affect the products that have been accepted.
All orders for products are subject to availability and, in this regard, if there are difficulties in supplying them, or if there are no items left in stock, the order will be cancelled and any amount the customer may have paid will be refunded.
2. Contract procedure
This information and the details contained in titilante.com do not constitute an offer to sell, but an invitation to do business. No contract shall exist between the client and TITILANTE in relation to any product until the order has been expressly accepted by TITILANTE (even if TITILANTE has already been debited from its account). If the offer is not accepted and the customer’s account has already been debited, the amount will be refunded to the customer in full.
To place an order, the customer must follow the online purchase procedure and click on “Order”. After this, you will receive an e-mail acknowledging receipt of your order (Order Confirmation). Please note that this does not mean that your order has been accepted, as it is merely an offer to TITILANTE to purchase one or more products. All orders are subject to acceptance by TITILANTE which will confirm such acceptance by sending an e-mail informing that the product is being sent (Shipping Confirmation). The contract for the purchase of a product between TITILANTE and the client (Contract) will be formalized only when the Shipping Confirmation with its corresponding invoice is sent to the client.
Only those products listed in the Shipping Confirmation will be subject to the Contract. TITILANTE shall not be obliged to supply any other products that may have been ordered by the customer until the dispatch of the same is confirmed in a separate Shipping Confirmation.
There may even be exceptional circumstances (in accordance with Law 10/2010, of 28 April, on the prevention of money laundering and the financing of terrorism) that make it necessary to refuse to process an order after having sent the Order Confirmation. TITILANTE reserves the right to do so at any time, at its sole discretion.
3. Parties’ obligations
3.1. Payment
The price of the products will be the one stipulated in each moment in titilante.com, except in case of evident error. Although TITILANTE tries to ensure that all prices listed on titilante.com are correct, errors may occur. If TITILANTE discovers an error in the price of the products the client has ordered, TITILANTE, after informing the client as soon as possible, will proceed to cancel the order. If TITILANTE is unable to contact the client, the order will be considered cancelled and TITILANTE will be fully reimbursed the amounts that have been paid.
TITILANTE is not obliged to supply products (even if the Shipping Confirmation has been sent) if the error in price is obvious and unmistakable and could reasonably have been recognized by the customer as an incorrect price.
Prices of TITILANTE products may vary, but (except as stated above) possible changes will not affect orders for which a Shipping Confirmation has already been sent.
Given the particularities of online shopping, the price of the products indicated in titilante.com refers solely and exclusively to purchases made in the same, without having to coincide with the retail price of TITILANTE establishments. In accordance with the above, the price indicated in titilante.com is only considered binding for online purchases.
The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and will be indicated to the customer in a detailed way.
Once the customer has made his purchases, all the items he wishes to buy will have been added to his cart and the next step will be to process the order and make payment. To do this the customer will follow 6 steps:
Client will click on “Cart” at the top right of the page to add the products that wish to purchase.
You will then click on “Process order”.
You will fill in and check the contact information, the data of your order, the address to which you want the order to be sent or the store where the order will be collected.
You will choose the method of payment with which you wish to make the purchase: credit card, debit card, PayPal, cash on delivery or gift voucher and enter the corresponding information.
You will accept the “Terms and Conditions”
You will confirm the purchase by clicking on “Checkout”.
The customer can pay by Visa, MasterCard, PayPal or transfer. To minimize the risk of unauthorized access, you will be redirected to the virtual payment gateway / PayPal screen that will authorize the payment of the order.
By clicking on “Authorize Payment” the customer is confirming that the credit card is theirs.
TITILANTE uses PAYCOMET to ensure that payment is made safely.
The credit cards will be subject to checks and authorizations by the issuing entity; if said entity does not authorize the payment, TITILANTE will not be responsible for any delay or non-delivery and, ultimately, for not formalizing the sales contract with the client.
Value Added Tax (VAT)
In accordance with current regulations, all purchases made through titilante.com will be subject to Value Added Tax (VAT), which will be charged at the rate applicable at the time of delivery.
3.2. Delivery
The shipment will be carried out by a transport company unrelated to TITILANTE, which undertakes to deliver the product paid for by the customer to the delivery address within a period of approximately 3 days
These deadlines may be extended to 45 days for some of the following reasons:
- Product customization.
- Special items.
- Unforeseen circumstances not attributable to TITILANTE.
- Product out of stock.
For the purposes of these Conditions, delivery will be deemed to have taken place or the product(s) will be deemed to have been delivered at the time of signing for receipt at the agreed delivery address.
The risks of the Products shall be borne by the customer from the time of delivery.
The customer will acquire ownership of the products when full payment of all amounts due in relation to the products, including shipping costs, is received.
4. Withdrawal
The customer has the right to withdraw from the contract within FOURTEEN (14) calendar days of receipt of the article.
To formalize the withdrawal, the customer must enter his personal area within the time indicated, enter to see the order and click on the button “reimburse my entire order”. A window will appear to indicate the reason for the return. You will receive an email indicating that the request has been sent successfully. A courier will pick up your order as soon as possible without any cost within 7 days.
Once the withdrawal is formalized and the article is returned along with its original packaging and the seal of the brand in perfect condition, the amount will be refunded as soon as possible, and in any case, within fourteen calendar days after TITILANTE has become aware of the customer’s withdrawal.
All payments received, including delivery charges if any, will be refunded. The means used for the return will be the same as the one by which the payment was made.
In cases where the return or exchange of the purchased product was accompanied by a promotional gift, the return of the product would entail the simultaneous return of the gift, all in the same state in which it was delivered. In the event that the gift cannot be returned or is not in the condition in which it was delivered, the return of the product that gave rise to the gift will not be accepted, unless the amount of the gift is paid.

6. Competent jurisdiction and applicable law
For any dispute arising from this online sales contract, the Spanish courts will be competent. Likewise, the Spanish law (Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios) will be applicable in all that is not foreseen in the present contract.
The European Commission offers a platform for alternative dispute resolution, which can be accessed from:http://ec.europa.eu/consumers/odr/ TITILANTE is not affiliated to any association or organisation offering an out-of-court dispute resolution system.
7. Intellectual and industrial property
All contents (including graphic design, source code, logos, text, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any elements appearing on titilante.com), unless otherwise expressly stated, are the exclusive property of TITILANTE or third parties.
No intellectual or industrial property rights over titilante.com or any of its components are assigned to the client. The client is expressly forbidden to reproduce, transform, distribute, publicly communicate, make available, extract, reuse, resend or use in any way, by any means or procedure, any of these, except in cases where it is legally permitted or authorized by the holder of the corresponding rights.
The customer may view and obtain a temporary private copy of the contents for their exclusive personal, private and not collective use in their computer systems (software and hardware), provided that it is not for the purpose of developing collective activities or commercial or professional. The client must abstain from obtaining, or trying to obtain, the contents by means or procedures different from those that in each case have been made available or indicated to that effect or from those that are habitually used on the Internet (provided that the latter do not involve a risk of damage or disablement of titilante.com). The client must at all times respect all the intellectual and industrial property rights of titilante.com, owned by TITILANTE or third parties.
In any case, TITILANTE reserves the right to modify, at any time and without prior notice, the presentation and configuration of titilante.com, as well as these Special Conditions
8. Availability of the Online Shopping Service
The Service will be permanently available 24 hours a day. TITILANTE informs the purchaser that there may be anomalies or interruptions in the availability or functioning of the Service due to causes not attributable to TITILANTE (technical problems of the Internet providers, telecommunications, problems in the purchaser’s terminal, etc.), so that the period for making the purchase may be extended.
